SUM
Sale, Use or Made, these are the three criteria that a patented product has to qualify. What this means is this; a product can be Sold in the US to a customer, Made in the US, but the end use customer is in Europe, the US patent as not been violated. OR, a product Sold in China, Made in the US and used in Europe and that also is OK. As long as the product isn’t Sold in the US, Used in the US and Made in the US, this is the only time that the US patent can be upheld.
